Maternity Benefits: The Maternity Benefit ammendment Act (2017 ) entitles women in india

The Maternity Benefit (Amendment) Act, 2017 is an amendment to the Maternity Benefit Act, 1961.

The amendment act was passed with the aim of providing better maternity benefits to women employees in India.

Here are some key provisions of the amendment act:

Extended Maternity Leave: The amendment act increased the duration of maternity leave from 12 weeks to 26 weeks for women employees who have worked for at least 80 days in the 12 months immediately preceding the expected date of delivery. Adoptive Mothers: The amendment act introduced the provision of 12 weeks of maternity leave for women who adopt a child below the age of three months. The leave can be availed of by the adoptive mother from the date of adoption.

Work from Home Option: The amendment act introduced the provision of work from home for women employees, which can be availed of after the expiry of the maternity leave period, for a duration that is mutually agreed upon by the employer and the woman employee.

Crèche Facility: The amendment act made it mandatory for employers with 50 or more employees to provide crèche facilities within a prescribed distance from the workplace. The employer is required to allow the woman employee to visit the crèche four times a day.

Provision for Nursing Breaks: The amendment act made it mandatory for employers to provide nursing breaks to women employees, in addition to the existing provision of two breaks of 15 minutes each for nursing until the child is 15 months old.

Option to Avail Leave in Advance: The amendment act introduced the provision for women employees to avail of maternity leave up to eight weeks before the expected date of delivery, on request. This can be done if the woman employee provides a medical certificate that confirms her pregnancy.
